Overview

Robin Barnes is a registered U.S. patent attorney and primarily focuses on patent and trademark prosecution, copyright registration, and intellectual property licensing. She has drafted and prosecuted numerous patent and trademark applications and has substantial experience managing the U.S. and international patent and trademark dockets for sophisticated clients with large intellectual property portfolios. Robin’s patent practice includes diverse subject matters ranging from natural gas processing, chemical compositions to prevent corrosion and scale in water systems, probiotic compositions for agricultural and food applications, lubricating greases, plumbing products, and software related to machine-vision, health improvement, reservation, and financial management systems. Robin works with her clients to gain an understanding of their business practices and goals and applies practical wisdom gained through decades of experience when advising her clients on patent, trademark, copyright, potential infringement, right to practice, and licensing issues, all in an effort to help her clients reach their goals within budget. Robin approaches IP negotiations on behalf of her clients with optimism and tenacity balanced by technical experience and an understanding of the business economics involved. She has negotiated and drafted numerous trademark co-existence agreements, trademark licenses, assignments, software development and license agreements, and complex patent licenses involving multiple patents and multiple parties.

Experience

In addition to her prosecution and transactional experience, Robin has extensive experience in intellectual property litigation. This experience enables Robin to consider long term consequences to anticipate and avoid potential pitfalls in patent and trademark prosecution and various transactional matters that may result in later litigation. Her litigation experience spans all aspects of intellectual property litigation, from pre-filing investigation through trial in several multimillion-dollar lawsuits involving claims of patent, trademark, and copyright infringement and cybersquatting. She has substantial experience in claim construction analysis and briefing complex patent, copyright and trademark issues at the district court and court of appeals levels.

Robin has drafted successful appeals to the Patent Trial and Appeal Board, Markman claim construction briefs, motions for summary judgment of non-infringement, to dismiss for lack of personal jurisdiction, to permit interlocutory appeal on patent-related subject matter jurisdiction, for reconsideration of an unfavorable ruling on a summary judgment motion (briefed by predecessor counsel) in a copyright infringement matter, and dozens of discovery-related motions. Robin has also been the primary draftsperson on four appeals at the Federal Circuit and two appeals at the Fifth CircuitPatent Trial and Appeal Board.
